RDC/COBRA KAI JIUJITSU ACADEMY — WAIVER AND RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

In consideration of being permitted to participate in any way in the martial arts program offered by RDC JiuJitsu Academy and/or being permitted to enter, for any purpose, any restricted area (defined as any area where admittance to the general public is prohibited), the undersigned participant (or parent/guardian if the participant is a minor) agrees to the following:

1. Inspection and Safety Acknowledgment
   The participant (or parent/guardian if applicable) agrees to inspect the training area and equipment prior to participation. If anything is believed to be unsafe, they must immediately notify staff and refrain from participating. The undersigned acknowledges and agrees to take all necessary precautions to avoid unsafe areas and cease participation if concerns arise.

2. Understanding of Risk
   The undersigned fully understands and acknowledges that:
   a. Martial arts activities involve risks which could result in serious injury, disability, paralysis, or death.
   b. These risks and associated damages may be severe, both socially and economically.
   c. Risks may arise from the participant’s own actions or inactions, from others’ actions or inactions, or from the negligence of RDC JiuJitsu Academy and its representatives.
   d. There may be risks not known or reasonably foreseeable at this time.

3. Assumption of Risk
   The undersigned voluntarily accepts and assumes all risks, known or unknown, and accepts full responsibility for any injuries, losses, or damages resulting from participation — regardless of cause — including those arising from the negligence of RDC JiuJitsu Academy and its staff, contractors, or affiliates.

4. Release of Liability
   The undersigned hereby RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE RDC JiuJitsu Academy, including its owners, directors, instructors, staff, agents, contractors, lessees of the premises, and any related parties (collectively referred to as “Releasees”), from any and all liability, claims, demands, damages, or causes of action related to any injury, loss, or damage — including death — sustained while participating in activities or being present on premises.

5. Danger Acknowledgment
   The undersigned recognizes that the nature of martial arts is inherently dangerous, and that injuries may be worsened by any rescue attempts or medical response. Participation is entirely at the individual’s risk.

6. Scope of Agreement
   This release is intended to be as broad and inclusive as permitted by applicable laws. If any portion is found invalid, the remaining provisions shall remain in full force and effect.

7. Indemnification
   The undersigned agrees to indemnify and hold harmless RDC JiuJitsu Academy and its Releasees from any claim brought by or on behalf of the participant, or any third party, for injuries, damages, or losses arising out of participation. If a claim is made despite this waiver, the undersigned agrees to reimburse RDC JiuJitsu Academy for any costs or liabilities incurred as a result.

8. Trial and Membership Terms
   The undersigned acknowledges that RDC JiuJitsu Academy reserves the right, at its sole discretion, to refuse or discontinue training for any participant during the two-week trial period or at any time during membership, should the participant be deemed unsuitable for the program.

9. Photography and Media Release
   The undersigned grants RDC JiuJitsu Academy permission to photograph and/or video record the participant (adult or minor) during classes or events. These materials may be used for promotional purposes, including but not limited to, the Academy’s website, social media platforms, and marketing materials. No compensation will be provided for such use.

I HAVE READ AND UNDERSTOOD THIS RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT. I ACKNOWLEDGE THAT I AM SIGNING IT VOLUNTARILY, WITHOUT INDUCEMENT, AND WITH FULL UNDERSTANDING THAT BY DOING SO, I AM GIVING UP LEGAL RIGHTS TO THE FULLEST EXTENT PERMITTED BY LAW.
